OPVIUS Wins Patent Appeal Against SOLARTENSION
(PresseBox) - The German Patent and Trademark Office (DPMA) in Munich has revoked patent DE 10 2010 029 739 B4 as part of an appeal process (not yet with legal effect).
OPVIUS GmbH has lodged an appeal against Patent DE 10 2010 029 739 B4 ?Solar plant with multiple power-generating film elements?, registered by Solartension GmbH in 2010 and issued in 2015. The first instance of the recently initiated appeal proceedings before the German Patent and Trademark Office (DPMA) in Munich has seen the DPMA agree with OPVIUS GmbH?s view. Following a hearing on 14/11/2018, the DPMA revoked the patent for lack of protectability in view of the technological standards cited by OPVIUS GmbH. The DPMA?s decision does not yet have legal effect and cannot yet be appealed.
