The Massaro Legal Group, LLC Secures Overwhelming Win Against State of Indiana
(firmenpresse) - FISHERS, IN -- (Marketwired) -- 12/02/14 -- The Massaro Legal Group, LLC, legal counsel to Defendant, LA Investors, LLC, today announced a judgment victory, on all counts, in the case brought about by the State of Indiana; alleging that LA Investors violated Indiana''s Deceptive Consumer Sales Act and Indiana''s Deceptive Commercial Solicitation Act.
LA Investors, LLC, a California company that is an analysis and retrieval firm, operates in Indiana under the assumed business names of Local Records Office and National Profile Document. The company creates Property Profiles that include, but is not limited to, real estate data such as property comparables, detailed transactional history, information about area foreclosure activity, zip code demographics, area schools, crime reports and a file-stamped copy of the pertinent deed for the owner''s personal records.
The State of Indiana alleged that the Defendants committed deceptive acts by sending envelopes and solicitation letters to Indiana consumers and leading toward governmental affiliation; however, it was found in the judgment that "The Court having completed a two (2) day bench trial in this matter finds in favor of Defendants and against Plaintiff on all Counts in Plaintiff''s Complaint" and that no violation was found regarding either Act.
At the outset of the litigation, counsel for LA Investors, Jason M. Massaro, of The Massaro Legal Group, was quoted as saying that he "firmly believe[d that] the state''s case lack[ed] any merit" and promised to put on a "vigorous defense to the litigation." Massaro states, "It is clear that the Attorney General''s office, as well as several local state offices, were too hasty in their persecution of LA Investors and should have done more due diligence before making statements to the public that were uninformed and inaccurate." There are additional pending lawsuits by the State of Tennessee and the State of Washington; however, Massaro states, "We expect a similar outcome to that of the State of Indiana for Tennessee and Washington and any other states that choose to follow suit."
Prior to the judgment and to-date, LA Investors, LLC has maintained that the envelopes and solicitation letters were not deceptive and were clearly marked as originating from a private company, not affiliated with any government agency. "The Defendant had displayed prominent disclaimers on the mailings, noting that they were not governmentally affiliated, that they were not affiliated with the county in which the consumer''s deed is filed, that the offer serves as a solicitation for services, that the solicitation was not to be interpreted as a bill due and that the customer was under no obligation to pay the amount stated," said Massaro, and "We are confident that the victory will restore LA Investor''s legitimacy and credibility and put to rest any misunderstandings about the nature of the product or their attempt to deceive."
