K-12 Association Concerned About Educators' Interpretation of "Fair Dealing"

(firmenpresse) - TORONTO, ONTARIO -- (Marketwired) -- 12/11/13 -- Dr. Gerry McIntyre, Executive Director of the Canadian Educational Resources Council (CERC), expressed that organization's disappointment at today's announcement that University of Toronto and Western University have declined to renew collective licences with Access Copyright. CERC is the trade association representing those publishers who specialize in the publication of Canadian educational resources for students in Junior-Kindergarten through high school and for elementary and secondary school teachers.

Dr. McIntyre noted that education publishers are concerned about the way that educational institutions, at all levels, are applying the new exception for "fair dealing for an educational purpose" that is in Canada's Copyright Act. Publishers disagree strongly with the education sector's interpretation of fair dealing. "Fair dealing," he said, "is about reasonable accommodation for spontaneous, situational uses. It is not a permission for the systematic delivery of free resources. The latter was certainly not the intention behind the latest amendments to the Copyright Act." Teaching, learning, writing and publishing are symbiotic and CERC members continue to believe in the potential to find common ground, and a solution that will work for everybody.
