The Complaint alleges that throughout the Class Period, defendants made materially false and misleading statements and/or omitted materially adverse facts about the Company's business, operations and prospects. In particular, it is alleged that the Company violated the False Claims Act and other federal and state statutes by improperly distributing the Novartis Pharmaceuticals Corporation product Exjade through its specialty pharmacy operations.
On September 23, 2013, the Company acknowledged the receipt of a civil investigate demand issued by the US Attorney's Office for the Southern District of New York and the receipt of a subpoena from the New York State Attorney General's Medicaid Fraud Control Unit.
