Specifically, this date is October of 2013, at which point it will have been eight years since the Bankruptcy Abuser Prevention and Consumer Protection Act of 2005 was enacted into law. The statute changed many of the standards and requirements for filing for bankruptcy protection, and among those changes were requirements for a waiting period for filing for bankruptcy protection for at least the second time.
According to the statute, people who have obtained a discharge under the standards set out by Chapter 7 of the United States Bankruptcy Code must wait for before seeking bankruptcy protection under the same chapter. The statute lays out this required waiting period in Section 727(a)(8). Given that many people filed for bankruptcy protection under Chapter 7 of the Bankruptcy Code in the weeks before this statute was enacted, that eight-year waiting period will expire for many people in October of 2013.
