The complaint alleges that during the Class Period ViroPharma made false and/or misleading statements, or failed to disclose material information regarding its drug Vancocin. On December 14, 2011, the Company stated that the Food & Drug Administration approved a supplemental drug application, and that Vancocin would receive market exclusivity for three years. Then on April 10, 2012, the Company revealed that the drug would not qualify for exclusivity, and that three applications for generic versions of the drug had received approval. The Company also acknowledged that it was under investigation by the Federal Trade Commission in relation to possible "unfair methods of competition" relating to the drug. Upon this news shares of ViroPharma fell more than 20 percent.
