Houston Criminal Defense Attorney John Floyd Publishes Series on Prosecutorial Misconduct in Wrongful Conviction of Michael Morton
(firmenpresse) - HOUSTON, TX -- (Marketwire) -- 03/07/12 -- John Floyd has published a series of articles discussing in the wrongful conviction of Michael Morton. Michael Morton was exonerated after being incarcerated for 24 years for killing his wife. Morton's release was triggered by DNA evidence exonerating him for his wife's murder that was found on a bloody bandana found at the scene of the crime, evidence that was never disclosed to the defense.
Williamson County District Judge Ken Anderson, who was the lead prosecutor in the Morton case, has become the primary target of misconduct allegations -- charges that the State Bar of Texas confirmed have sparked disciplinary investigation into Anderson's conduct in the Morton case. Additionally, a has commenced to examine whether Judge Anderson committed the offenses of Contempt of Court, Fabricating With or Tampering with Physical Evidence and Tampering with Government Records -- all in connection with the Morton case.
"Based on the public record, I have little doubt that Judge Anderson engaged in prosecutorial misconduct and perhaps criminal offenses in what appears to be a cover-up," said Houston Criminal Defense Attorney John Floyd.
"I only hope that the findings of the court of inquiry will be passed along to the State Bar and to the proper prosecuting authority with recommendations for criminal action, if supported by the evidence. With the continual stream of wrongful convictions coming to light, it is high time that intentional prosecutorial misconduct no longer be encouraged or tolerated. The only way to end what appears to be a blatant pattern of prosecutorial misconduct is , something sorely missing from the current criminal justice system," said Mr. Floyd.
