Founding Partner of OC Law Firm Wins Two and a Half Year Road Rage Case

DeGrave, Esq., a Founding Partner of Poliquin & DeGrave LLP in Laguna Hills, CA, recently won his "most satisfying trial result" for the October 18, 2011 ruling, a Defense verdict 12-0, at the Los Angeles Superior Court (Central), located at 111 N. Hill Street, Dept. 20 on behalf of his clients, defendants William Olds and Land Logistics, Inc.
In the case of plaintiffs Jose Luis Cervantes and Maria Elena Cervantes, represented by Alessandro Assanti, Esq. and plaintiffs Cesar Meza and Oscar Vasquez (in related matter), represented by Charles Ferrari, Esq. (in related matter) vs. defendants Land Logistics and William Olds, represented by Douglas M. DeGrave, Esq., plaintiffs claimed the defendant killed Edwin Cervantes, 19, who was traveling on a motorcycle at a high rate of speed, on August 14, 2008 in an incident of alleged road rage on the I-710 freeway.
The Cervantes family claimed Olds, the driver of the truck, intentionally cut off the motorcyclists in an attempt to intimidate them, and sought recovery of $2,000,000. Meza and Vasquez, who were present during the incident, also sought damages.
Heard by Honorable Kevin C. Brazile, the court ruled Meza and Vasquez had failed to prove their claims of negligence and assault by Olds.
The jury returned a unanimous verdict in favor of the defendants on the death case brought by the decedents' parents.
DeGrave, 57, of Villa Park, says of the case, "Justice was done. Olds was a victim of the motorcyclists' recklessness and attempted cover-up, and plaintiffs put our clients through two and a half years of false allegations and burdensome discovery based on outright fabrications."
According to the case summary, after the verdict, several jurors commented that they were convinced the truck driver did nothing wrong; Olds was in his lane and the motorcyclists were all traveling at an unsafe speed while illegally passing the truck on the shoulder.
Says DeGrave, "It may be my most satisfying trial result, because our client truly is a gentleman, who did nothing wrong. This was the classic attempt to get what plaintiffs perceived as a 'deep pocket.'"
